Customer: any natural or legal person, as defined in Article 3 of the General Terms and Conditions of Sale, who purchases one or more Documents from the Website.

General Terms and Conditions of Sale: this document.

Contract: the provisions of the General Terms and Conditions of Sale as well as those published on the Website, as completed by the Customer.

Documents: Peugeot declarations and certificates of compliance on sale on the Website, as listed in Article 4 of the General Terms and Conditions of Sale, subject to subsequent modification.

ARTICLE 1 – DEFINITIONS

Documents: Citroën declarations and certificates of compliance on sale on the Website, as listed in Article 4 of the General Terms and Conditions of Sale, subject to subsequent modification.

ARTICLE 2 – VENDOR – CONTENT AND FORMATION OF THE CONTRACT

The General Terms and Conditions of Sale define the terms and conditions covering the sale of Documents on the Website by Automobiles Citroën.

When Documents relating to a Citroën vehicle are sold on the Website, the vendor is Automobiles Citroën, as manufacturer of Citroën vehicles.

Purchasing Documents on the Website implies prior and unqualified acceptance of the Contract, composed in particular of the General Terms and Conditions of Sale as sole applicable terms to the exclusion of all others.

By validating an order on the Website, the Customer confirms their full acceptance of the terms of the Contract.

The general terms and conditions of sale may be printed or downloaded to the hard disk of the Customer’s computer.

ARTICLE 3 – CONDITIONS FOR ACCESS TO THE WEBSITE

The Website and Documents ordering system are accessible exclusively to persons meeting the following conditions:

– adult natural persons (individuals) and companies based in the countries listed on the Website,

– owners of a Citroën vehicle, new or used, or persons duly authorised by the owner of a Citroën vehicle.

The Customer must provide all the information and items requested on the Website in order to obtain the desired Document(s).

It is up to the Customer to connect at their own expense and under their sole responsibility to the Internet in order to access the Website. The Customer is solely responsible for the proper operation of their computer equipment and its Internet access.

Automobiles Citroën reserves the right to block access to the Website at any time, in particular due to maintenance or updates, without prior notice and without conferring any right to compensation to Customers.

ARTICLE 4 – DOCUMENTS FOR SALE

The Customer may purchase Documents provided by Automobiles Citroën on the Website, including:

– Certificate of Compliance (COC)

– Manufacturer’s partial identification certificate

– Manufacturer’s descriptive note

The above list may be modified at any time without notice by Automobiles Citroën.

ARTICLE 5 – DOCUMENT PURCHASE PROCESS

The Customer selects the Document(s) that they wish to order.

The Customer must then provide their personal details, delivery and invoicing address for the Documents as well as the specifications of the Citroën vehicle(s) for which they wish to order one or more Document(s). The Customer undertakes to provide accurate and up-to-date information.

The Customer must attach any supporting documents necessary for their order to be processed by Automobiles Citroën, as indicated on the Website depending on the document(s) selected. The Customer must, in a trustworthy and sincere manner, attach documents that are legible, complete, authentic and not fraudulently obtained.

To be able to place an order, the Customer must tick a box stating their acknowledgement of having read and fully accepted the General Terms and Conditions of Sale, an essential condition for placing their order.

The Customer must then confirm a summary of their order. You are hereby informed that, until an order is confirmed, the Customer may go back and modify the type of Document(s) and/or the information provided for the preparation of the selected Document(s), delete and/or add another Document(s). The ability to order Documents for several vehicles at a time is only possible for orders of a single Document type, to be specified at the beginning of the process.

The Customer has the option to check the details of their order and the total price and to correct any errors before confirming their acceptance.

After confirmation and final validation of an order, the Customer accesses the secure payment system and proceeds with online payment. Only full and effective payment of an order (i.e. the payment actually received by Automobiles Citroën and/or its e-commerce partner Ingénico) validates the Customer’s order. Failing this, the Customer’s order will not be processed.

Once an order has been paid for, it can no longer be modified or cancelled by the Customer. An order confirmation email is sent to the Customer, providing a summary of the order concerned. An invoice is sent to the Customer by email along with a confirmation of dispatch upon sending the document.

ARTICLE 6 – PRICES AND PAYMENT METHODS

The prices displayed on the Website are expressed in euros inclusive of all taxes, based on the rates of Value Added Tax and other taxes in force in France on the day on which the order is placed.

The total amount of the order must be paid in full on the Website on the day on which the order is placed No discount or payment deferral shall be granted.

Payment is to be made by credit/debit card (CB, Visa or MasterCard) by means of a secure payment system accessible through the Website. The collection of information relating to the Customer’s credit/debit card and payment of the order is governed exclusively by the provisions provided for by Ingénico, the e-commerce partner of Automobiles Citroën, which appears on the payment confirmation page. The latter is the sole guarantor of the security of payments made on the Website and is solely responsible for the collection and processing of information and the content of the aforementioned Documents and Website.

ARTICLE 7 – DELIVERY

Delivery methods are defined on the Website. No fee is charged for delivery costs of the Documents in addition to the price of the Documents.

If Automobiles Citroën discovers, while processing the Customer’s order, that the order contains incorrect or incomplete items, information or attachments, Automobiles Citroën will notify the Customer by email. The latter will then be invited to modify and/or complete the relevant information or documents by sending an email to coceurope@mpsa.com with the corrected items or documents, within a maximum period of 14 (fourteen) working days from the date of receipt of the email sent by Automobiles Citroën.

Delivery of the Documents by Automobiles Citroën will take place within 7 (seven) working days, at the delivery address indicated by the Customer on the Website while placing their order.

Delivery time, as indicated above, is counted from the date of full and effective payment of the order and the date of receipt by Automobiles Citroën of all completed information and supporting documents, whichever of these two dates is the later.

Special cases: Deliveries cannot be made to PO boxes, postal collection services, armed forces post boxes and, more generally, to any incomplete or incorrect addresses. If the Customer resides within a remote plot of land with a local name (lieu-dit) or in a hamlet or district not located on a street, they must ensure that the second line of their delivery address specifies any information useful for correct delivery.

Any repeat dispatch of documents ordered as a result of the Customer specifying an incorrect postal address will be invoiced at the price of EUR 40 (forty euros) including tax if the request is received within one month of the order being placed. After one month, the document will be invoiced at the same rate as a first order.

ARTICLE 8 – LACK OF RIGHT OF WITHDRAWAL

In accordance with the French Consumer Code, the Customer is informed that they have no right of withdrawal following the delivery of the ordered Documents, to the extent that they have been prepared at their request, in accordance with their specifications and that these are clearly customised to the Customer’s vehicle.

ARTICLE 9 – ORDER TRACKING – QUESTIONS – COMPLAINTS

For any question or complaint relating to an order or to a Document purchased on the Website, the Customer must contact Automobiles Citroën, the contact details of which are as follows: Automobiles CITROEN– Certificates of Compliance Service, Correspondence address: YT 491 – 2-10 Boulevard de l’Europe, 78300 POISSY, FRANCE Cedex or by email to the following address: coceurope@mpsa.com. These details are also available on the Website.

The Customer has 14 (fourteen) calendar days from the date of receipt of the Documents ordered to declare, by email to Automobiles Citroën at the email address above, any material errors affecting the Documents, attributable exclusively to Automobiles Citroën.

The Customer must specify in detail the exact items to be included on the corrected Document, which will be sent (free of charge if the correction request is justified) by Automobiles Citroën to the Customer within a maximum period of 14 (fourteen) days from receipt of the Customer’s email.

ARTICLE 10 – ORDER CANCELLATION

In the event that the Customer has not provided all of the documents and information necessary for the processing of their order by Automobiles Citroën within 14 (fourteen) days of the deadline set out in Article 7 of the General Terms and Conditions of Sale, Automobiles Citroën reserves the right to cancel the order at any time and without compensation for the Customer or right of appeal, by sending the Customer a registered letter with proof of delivery, informing the Customer of this cancellation.

In the event that Automobiles Citroën has not amended a Document containing material errors exclusively attributable to Automobiles Citroën at the request of the Customer, within 14 (fourteen) days of the deadline set out in Article 9 of the General Terms and Conditions of Sale, the Customer has the option to cancel the order, in the case of a non-compliant Document, by sending an explicit cancellation letter by email or by post to the address given for Automobiles Citroën stated in Article 9 of the General Terms and Conditions of Sale, clearly stating the first name and surname of the Customer given at the time of placing the order, the order number, total amount including tax and date of the order.

In this case, an order cancellation can only be effective from the date that the original Document, returned by the Customer by post at the Customer’s expense, is received by Automobiles Citroën. No refund can be made without the Document being returned.

The Customer undertakes not to store nor use, for any reason whatsoever, any copy, reproduction or representation of the Document thus returned.

A refund by Automobiles Citroën to a Customer relating to a cancelled order or for the price of the original returned Document, will be paid by Automobiles Citroën directly to the credit/debit card used for payment (or by another means explicitly accepted by the Customer in advance), within 14 (fourteen) days from the date that the cancellation letter is received and, where applicable, the original Document is received. This amount cannot generate interest.

ARTICLE 11 – PERSONAL DATA

The Customer is informed that the information collected by Automobiles Citroën on the Website is necessary for it, its subsidiaries, its sales network, any company that may offer a service on behalf of Automobiles Citroën and/or any company belonging to the same Group as Automobiles Citroën, for the processing of the Customer’s order, and may be used by Automobiles Citroën, its subsidiaries, its sales network, any company that may offer a service on behalf of Automobiles Citroën and/or any company belonging to the same Group as Automobiles Citroën in order to offer commercial products, search and analysis services.

As a part of its activities, Automobiles Citroën may need to transmit the Customer’s data to other countries, for one of the purposes for which the data was initially collected or for the purposes to which the Customer subsequently consented. When the Customer’s data is transferred to a third country, Automobiles Citroën takes all necessary measures to avoid causing any harm to the Customer. The data is transferred only to countries where an adequate level of data protection is guaranteed. The data may be transferred to countries that are not members of the European Union.

ARTICLE 12 – VALIDITY OF GENERAL TERMS AND CONDITIONS OF SALE AND PRICES

The General Terms and Conditions of Sale, the Documents and the prices thereof appearing on the Website may be modified at any time without notice by Automobiles Citroën. Modifications are valid from the moment they are posted on the Website.

All orders are governed by the General Terms and Conditions of Sale and the prices displayed online on the Website at the time an order is validated.

ARTICLE 13 – LIABILITY

The Customer is solely responsible for the use it makes of the Documents obtained and for the direct or indirect consequences of this use. It is up to the Customer to make use of the Documents in accordance with current regulations. Under no circumstances may Automobiles Citroën be held liable for any damage, infringement or any incident of any kind resulting from the use and/or exploitation of the information and Documents provided, in particular for the purposes of fraudulent registration.

As a result, Automobiles Citroën cannot under any circumstances be held liable for, inter alia, the transmission and/or receipt of any data and/or information on the Internet; for any malfunction of the Internet or technical network preventing access to the Website and/or the proper operation/processing of the Customer’s order; for the failure of any receiving equipment or lines of communication; for the loss of any paper or electronic mail and, more generally, for the loss of any data; for any problems of transmission or routing; for any software malfunction; for any technical or equipment malfunction preventing or limiting the Customer’s ability to place an order on the Website and/or receive the Documents ordered thereon. In the event of a technical malfunction, Automobiles Citroën reserves the right, where applicable, to invalidate and/or cancel a Customer’s order placed during that malfunction. No claims will be accepted as a result of this.

More generally, the liability of Automobiles Citroën cannot be incurred for any breach in the performance of its obligations resulting from a case of force majeure, exceptional circumstances beyond its control, a deed performed by the Customer, or to any reason external to Automobiles Citroën. No appeal may be brought against Automobiles Citroën.

If the liability of Automobiles Citroën were to be engaged in the performance of the Contract, it may only be sought for a proven fault and for direct and foreseeable damages caused exclusively by a failure of Automobiles Citroën to comply with its obligations, excluding in particular indirect damages, loss of profit, turnover, customers, information, commercial damage etc. In this case, the Customer may only claim other compensation and damages by reason of error or interest, other than the payments already refunded in respect of the order concerned by the failure or error exclusively attributable to Automobiles Citroën.

ARTICLE 14 – APPLICABLE LAW – LANGUAGE OF THE CONTRACT

In the event of a dispute relating to the General Terms and Conditions of Sale and the Website, only the Paris courts will have jurisdiction, unless otherwise stipulated by law. They shall rule exclusively under French domestic law, excluding those rules relating to conflicts of law and without prejudice to the legal provisions of the country of residence of the Customer to which no exemption may be made.

The Contract is drawn up, depending on the country, in the French language, or in the official language of the country in question. In the event that differences arise between these versions and the French version of this contract, only the French version will be considered valid.

If one or more stipulations of the General Terms and Conditions of Sale are deemed invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, they shall be deemed void and the other stipulations shall remain in force.
